Personal accident claims. What good are they?

An ever increasing number of people get hurt or suffer every year due to the negligence of others. If we were to give an estimate number of those persons I believe we could easily reach the amazing sum of 3-4 million people. One would immediately expect, Oh my God, that’s a lot of personal accident claims, all brought together.

Sadly, we will disappoint you. Out of this great number of victims no more than 30-40% actually do decide to claim against the guilty party, while the rest of them either are not aware of their civil right to claim for compensation, or fear that they might have to pay tremendous legal fees. The good news, yes, there is good news in this entire situation, is that more and more people find out about their right to claim, about how easy it is now and about that whole “no win no fee” policy that lawyers practice. This policy, new, as it were, for the unadvised populace basically states that you can claim at any time and for anything as long as you have the grounds to argument and prove what you are saying. If you win, your attorney will have his fees paid by the accused and if you lose you will have nothing to pay to your legal adviser. This method encourages people to claim and really gives them the feeling of security and trust in their own side of the truth.

Moving onwards, let’s see what a personal accident claim stands for. First of all, a personal accident can include various types of injury such as: whiplash injuries, back injury, cervical injury, leg/arm/wrist injuries, industrial diseases, temporary/permanent loss of sight or hearing, etc. And these are just the first that cam to my mind, on the spot. Every little accident having been caused by another person or because of the negligence of your employer and that has or had as a result your being injured is a good enough reason for you to file a complaint and make a compensation claim.

This is not all. A personal accident claim can be filed also for other reasons and not merely for physical damage. Mental and psychological problems such as post-traumatic stress, anguish, depression, panic attacks, abuse, etc are all the more reasons for a claim to be filed. Now that we have seen what we can claim for, how about a quick briefing on how much compensation we deserve.

Compensation is asked by your personal solicitor, but established by the court of law after your case has been studied. The compensation usually covers all aspects of your traumas: physical and psychological damage, expenses due to accident, medical visits and bills, working ability, damaged property etc.

The first condition of all personal accident claims is truth. You must not lie about any aspect of your claim. The second is a good lawyer on your side who can take care of your situation and who can give you the best legal counsel possible. These two completed, you are ready to make your claim.
